House Rules
1. Guest agrees to abide by all rules and regulations contained herein or posted on the premises related to the Rental Property.
2. CHECK-IN IS GENERALLY BETWEEN 4 PM AND 10 PM/CHECK-OUT IS BY 10 AM.
a. Host will be available by Airbnb messaging between 10 AM and 10 PM. Limited emergency phone services are available after hours.
b If guest takes possession of unit by arriving prior to check-in time or being physically in the unit or placing guest's belongings in the unit after notification of a delay in check-in time, cleaners cannot complete their work. The guest accepts the condition of the unit as-is regardless of condition. There will be no refunds due to cleanliness issues if cleaners are unable to complete their jobs.
3. NO SMOKING OR VAPING OF ANY KIND IN UNIT, ON THE BALCONIES, OR IN PROPERTY COMMON AREAS.
a. SMOKING WILL RESULT IN A MINIMUM ADITIONAL CHARGE OF $300.
b. MARIJUANA USE and use of other illegal substances will result in a call to law enforcement, eviction without refund, and a minimum additional $300 fee.
c. Guests caught smoking will be removed by the property manager, security, or law enforcement and no refund will be provided.
d. Owner/Manager will, to the best of their ability, maintain the unit as smoke free. There will be no refunds for smoke smells in the unit or coming from a nearby unit in violation of these rules.
4. NO PETS ALLOWED - Per HOA Rules there are no pets permitted by rental guests.
a. Violation will result in immediate termination of your rental, removal by the property manager, security, or law enforcement and no refund will be provided.
b. An additional minimum charge of $300 will be added for damages/additional cleaning.
c. If the presence of your dog results in a fine to the owners by the HOA, you will be responsible to pay that fine.
5. The property rented will be returned in the same general condition in which it was rented and the Guest will be responsible for all damage and/or loss that occurs during my rental period.
6. CHECK-OUT IS BY 10AM. We generally cannot accommodate late check-outs due to the cleaning schedule. Late checkout without advance permission from host will result in a charge of 2x the average nightly rate for the time the guest is staying. If this results in a cancellation of a subsequent reservation, the guest will be liable to reimburse the host for all of the lost revenue due to the cancellation.
7. Guests hereby acknowledge and grant specific permission to Manager, Owner or their Staff to enter premises at any time for inspection purposes.
a. THE GUEST WILL NOT DENY ACCESS TO ANY EMPLOYEES OR CONTRACTORS SENT TO SERVICE THE PROPERTY OR REALTORS SENT TO SHOW THE PROPERTY, IF APPLICABLE.
b. REGULARLY SCHEDULED EXTERMINATION SERVICES ARE MANDATORY AND GUESTS WILL NOT DENY EXTERMINATORS ACCESS.
8. Daily maid/towel/linen services are not provided.
9. No rearranging furniture. Rearranged furniture will result in an added cleaning charge (to put things back). Damaged furniture (for any reason) will result in replacement charges. If 1 part of a matched set cannot be replaced, the guest agrees to replace the full set.
10. NO INDOOR FURNITURE ON THE BALCONY - This will result in damage charges if furniture gets wet/damaged.
11. Broken items not reported on the first night of a stay will result in a charge for damages.
12. The guest understands that they are visiting a subtropical climate, that insects live outdoors, and that insects may enter the unit through an open door or window. The guest will KEEP EXTERIOR DOORS CLOSED EXCEPT FOR INGRESS/EGRESS to prevent insects and prevent unit damage from humidity.
13. Thermostats may be adjusted for comfort However, at no time is the thermostat, door lock, or other items to be removed or disconnected from the network.
14. The guest accepts full responsibility for the condition of towels, linens, and other bedding when they use them.
a. Stains and damage that would be unreasonable to use for future guests will result in replacement charges.
b. If 1 part of a matched set cannot be replaced, the guest agrees to replace the full set.
c. Linens, towels, and bedding provided in the Rental Property will not be removed from inside the unit by the Guest for any reason and will not be left on balconies or given to building staff at any time, as they are part of the private rental of the Property and not part of any building's linens program.
15. PRIOR TO CHECKOUT, the guest will wash their dishes, empty the refrigerator, pick up all visible debris from the floors and furniture, and bag all trash. Trash should be disposed in the designated trash areas for the building. Only dishwasher detergent (not liquid dish soap) can be used in the dishwasher. The guest will be responsible for a the cost of repairs if improper dish soap is used in a dishwasher.
16. CLEANING IS INCLUDED in your departure cleaning rate, but PICKING UP IS NOT: Cleaning includes vacuuming, dusting, surface cleaning, towel/linen laundry, making beds, and putting away clean dishes. Cleaners do not expect to have to handle bodily fluids and hazardous waste fees will apply for urine, feces, vomit, or other bodily fluids not cleaned properly by guests.
17. NO PARTIES. DISTURBANCES WILL RESULT IN REMOVAL BY SECURITY OR LAW ENFORCEMENT WITH NO REFUNDS. If posted quiet times will be observed by guests.
Elevator access cards are obtained from the property reception and are to be returned to the desk upon checkout.
18. Guests obligations include but are not limited to keeping the premises as clean and safe as the conditions of the premises permit and causing no unsafe or unsanitary conditions in the common area and remainder of the premises that Guest uses.
19. Guests agree not to use the premises for any commercial activities or purpose that violates any criminal law or governmental regulation.
20. Guest will pay for all damages, missing items, and charges for fines/fees incurred by the owner/manager as a result of the misuse of this rental, and any/all legal and collection fees incurred by the owner/manager plus the statutory maximum interest rate for any unpaid portions of these charges after 30 days of non-payment. The guest agrees that they will not “charge back” any amount charged to cover damage/misuse/theft/rental fees.
21. RENTER AGE – Renters under the age of 23 must obtain written permission of host in advance of booking. Names and identification may be requested by host. ALL GUESTS (not just the booking guest) not accompanied by a parent or legal guardian must be at least 18 years old.
22. The maximum number of guests is listed in the ad and will not be exceeded.
a. No fraternities, school, civic, or other non-family groups are allowed unless Owner grants prior approval. In no event shall Guests assign or sublet the Rental Property in whole or in part.
23. The renter HAS READ THE LISTING CAREFULLY and will have access to only those amenities listed in the advertisement to which he/she responded and will not attempt to access locked areas of the unit or building/resort. The host is not responsible for the guest's failure to read the listing description regarding amenities and guest access, and no refunds will be given for this.
24. Any reservation obtained under false pretense will result in cancellation/removal of guest with no refund.
25. Parking. The host is not responsible for guests' vehicle being towed, damages to vehicles, or personal belongings left in vehicles.
26. If the owner/manager does not hear from the renter by 9pm on the evening of arrival, it will be assumed that the unit is acceptable to the renter and in good condition. If a guest has a cleaning or maintenance issue, they will give the manager the opportunity to correct the issue in a reasonable amount of time during normal business hours. No compensation will be provided for issues where reasonable efforts have been made to correct the problem, where the guest fails to report the problem in a timely fashion, or where the guest refuses to allow the manager to correct the problem.
27. The owner/manager is not liable and there will be no compensation for failures of appliances, electronics, utility outages/issues, pools, hot tubs, amenities, elevators, building mechanicals, fabric stains, for weather related issues or evacuations, or for any cancellations or closures of amenities, events, or area businesses. To the extent that any of these issues are in the control of the host or owner, every reasonable effort will be made to assure that appliances and decor will be and remain in good working order.
28. The renter assumes all risk involved with use of this condo, the balcony, and all other areas of the resort property or association grounds for the renter and all persons, including minor children, entering the property.
a. The renter agrees to save, indemnify and hold harmless the owner, property manager, resort, homeowner’s association, contractors, their respective insurers, and any animals owned by any of those entities for any/all loss, damage, expense, penalty, personal injuries (including death), or loss of property sustained by any person whatsoever as a result of the use of any portion of the premises or surrounding area of the property. The renter assumes full responsibility for all person's entering the premises during the renter's contracted time of stay.
29. In the event Manager is unable to make Rental Property available for any reason other than described above or a reasonable substitute as determined by Manager, Guest agrees that Manager's sole liability as a result of this unavailability is to provide a refund of all monies paid under this Agreement and Guest expressly acknowledges that in no event shall Manager be held liable for any special or consequential damages which result from this unavailability.
30. Manager may terminate this Agreement upon the breach of any of the terms hereof by Guest or misrepresentations made when booking. Guest shall not be entitled to the return of any rental monies paid under the terms of this Agreement and shall vacate the Property immediately or face removal by the host, management, security, or law enforcement.
31. A security deposit or authorization is required. Damages, theft, other losses, balances due, and failure to abide by this rental agreement, will result in the security deposit being retained by the host.
a. Should the damages exceed the amount of the Security Deposit, Guest agrees to pay the balance within five (5) business days after receiving notification.
b. Deductions from Security Deposit may include, but are not limited to: excess cleaning fee, trash removal fee, missing item replacement costs, dishwashing fee, damaged item replacement or repair costs, repair costs of buildings or grounds, failure to abide by the rental contract, or other service call fees. Manager is under no obligation to use the least expensive means of restoration.
32. IF YOU ARE ON A PAYMENT PLAN AND YOUR RESERVATION IS CANCELLED FOR NON-PAYMENT FOR ANY REASON, THE NORMAL CANCELLATION POLICY APPLIES, REGARDLESS OF HOW THE BOOKING WAS MADE.
a. For non-Airbnb guests: If a booking is made more than 30 days in advance, a payment of 50% will be taken by the owner at the time of booking. Any remaining balance must be paid by 30 days prior to the arrival date. This is the standard payment plan unless another agreement is reached prior to booking.
b. For Airbnb guests: Airbnb handles the collection of payments and your payment agreement is whatever option you selected at the time of booking.
33. Agreement shall be enforced under the laws of South Carolina, including any applicable rental acts , and represents the entire Agreement.
a. Any amendments must be in writing and signed by both parties. In the event of a dispute, legal action may only be instituted in the county within which the Rental Property is located.
b. If any part of this Agreement shall be deemed unenforceable by law, that part shall be omitted from this Agreement without affecting the remaining Agreement.
c. Owner shall conduct all activities in regard to this Agreement without respect to the race, color, religion, sex, national origin, handicap, or familial status of any Guest.
34. THE GUEST HAS READ AND UNDERSTANDS THE CANCELLATION POLICY AND AGREES TO IT BY BOOKING.
35. Guest will be required to sign a rental contract and provide point of contact information. Failure to do so will result in check-in instructions not being sent to guest with no refund of monies paid.
